Tier 2 (Intra Company Transfer) 


Tier 2 ICT Long Term – Tier 2 ICT Short Term – Tier 2 ICT Graduate Trainees – Tier 2 ICT Skills Transferresidence permit

Intra-company tranfers are for migrants who have been working for multinational organisations and who are being transferred by an overseas employer to a related UK employer

This route is not affected by the permanent limit and falls under a Sponsor’s unrestricted COS allocation.

It is divided into 4 sub categories:

– Long term staff (“LTS”)

–  Short term staff (“STS”)

–  Graduate trainees
(GT)

–  Skills Transfer 

(ST)

Long Term Staff

This sub-category must be used to transfer existing employees to the UK for a period of up to 5 years (or 9 years if the migrant is a high earner).

Key points

  • 12 months of experience required with Sponsor overseas
  • Minimum annual salary package of £41,500
  • Job must be at graduate level or above (NQF level 6 or above)
  • Approved for any period up to a maximum period of 5 years (3 years plus 2 year extension)
  • No return to UK as Tier 2 (ICT) for 12 months after visa/leave expires (“12 month cooling off period”)
  • This route does not lead to settlement (ILR)

 

Short Term Staff

This sub-category must be used to transfer existing employees to the UK for a period of up to 12 months.

Key points:

  • 12 months of experience required with Sponsor overseas
  • Minimum annual salary £24,800
  • Job must be at graduate level or above
(NQF level 6 or above)
  • Approved for maximum period of 12 months (no extension possible)
  • No return to UK as Tier 2 (ICT) for 12 months after visa /leave expires (“12 month cooling off period”) unless returning as an ICT Long Term Staff

 

Graduate Trainees/Skills Transfer

Graduate Trainees

This sub-category can be used to transfer recent graduate recruits to the UK for training – this route must not be used to fill long-term posts. Migrants in this sub-category must be coming to the UK as part of a structured graduate training.

Key points:

  • 3 month experience required with Sponsor overseas
  • Minimum annual salary £24,800
  • Job must be at graduate level or above (NQF level 6 or above)
  • Must be used for graduate on accelerated promotion schemes only (maximum 5 graduates per year)
  • May come to the UK for up to 12 months (no extension possible)
  • No return to UK as Tier 2 (ICT) for 12 months after visa /leave expires (“12 month cooling off period”) unless returning as an LTS

 

Skills Transfer

This sub-category can be used to transfer existing employees to the UK, for any period up to a maximum of 6 months, to acquire the skills and knowledge needed to do their job overseas, or to provide their specialist skills and knowledge needed to do their job overseas, or to provide their specialist skills to the UK workforce.

The purpose of the transfer must be to acquire or share skills and knowledge and must be incidental to the transferee’s employment overseas.

The transferee’s role must be over and above normal staffing requirements in the UK (i.e. supernumerary) – in other words, if the skills transfer was not needed, the role in the UK would not exist.

This sub-category must not be used to fill a UK vacancy or to displace resident workers.

On the job training and work is allowed if it is undertaken in line with the skills transfer – for instance it would not be acceptable for a ST migrant to come to the UK to learn about 3 D graphics but then undertake work as a RF Layout Engineer.

Acceptable examples of Skills Transfers include: you are engaged to up skill a client and need to bring a migrant in to help because the skills are not available in the UK or a migrant worker is brought in to acquire the skills needed to allow them to fulfill a project or other obligations outside the UK when they return overseas.
